The Centre has stated that it is not the court's place to create a new social institution by supporting same-sex marriage. The decision should instead be left to Parliament and the people to determine whether it is socially and religiously acceptable or not. The government submitted an affidavit just before the Constitution Bench, led by Chief Justice of India D.Y. Chandrachud, began hearing the same-sex marriage case.
